L’œuvre philosophique de Lambert a souvent été traitée comme un moment de l’histoire de la formation de la pensée kantienne et des antécédents de la Critique de la raison pure. C’est en méconnaître l’originalité. Les deux ouvrages à cet égard les plus importants, le Nouvel Organon (1764) et l’Architectonique (1771) ont été conçus originellement comme les parties complémentaires d’un même projet qui s’inscrit dans la longue histoire de l’union entre logique et métaphysique. L’architectonique est une doctrine des catégories : le (...) recensement des notions ou concepts simples permettant de penser un objet quelconque réalise, en en déplaçant le champ d’application, la visée d’universalité qui définissait la métaphysique générale ou philosophie première dans les ontologies wolffiennes. Ce n’est plus une doctrine de l’étant comme tel, mais une anatomie de l’entendement inspirée par Locke. Cependant le traitement des concepts simples ainsi obtenus revient à la méthode mathématique suivant l’exemple de Wolff, corrigé par un retour au modèle euclidien : il s’agit, somme toute, de procéder pour chaque concept simple comme Euclide l’a fait pour l’un d’entre eux, celui de l’espace. L’architectonique peut ainsi, par l’établissement des combinaisons et dérivations de ces concepts, livrer le plan systématique du tout de la connaissance. Ainsi, la singularité de Lambert trouve mieux sa place dans la lignée qui va de la Science Générale leibnizienne à la Doctrine de la science (Wissenschaftslehre) de Bolzano ; et on peut y voir aussi, comme Cassirer l’a proposé, une préfiguration de la théorie de l’objet (Gegenstandstheorie) de Meinong. The financial crisis has led to new interest in the ethics of financial markets. In this article, we further the debate on the nature of banking contracts by showing that the fundamental subjective purposes of loan and deposit contracts are irreconcilable. Any resultant mixture of the two contracts is a legal aberration. We consider a mutual fund as an important and legitimate alternative to the common demand deposit to provide high liquidity and some yield without offering full availability of a (...) nominal sum. Besides being a close substitute for how many deposit accounts function today, the mutual fund has the additional benefit of satisfying all legal and ethical requirements. Loan and investment contracts allow for the “bank” to make use of their clients’ funds while the intents of money owners are clearly classified without running into legal or ethical problems. Although the principle of informed consent is well established and its importance widely acknowledged, it has met with criticism for decades. Doubts have been raised for a number of different reasons. In particular, empirical data show that people regularly fail to reproduce the information provided to them. Many critics agree, therefore, that the received concept of informed consent is no more than a myth. Strategies to overcome this problem often rest on a flawed concept of informed consent. In this paper, (...) it is suggested that informed consent is a communicative act between two persons. The challenge is to elucidate the norms and constraints for successfully performing such a communicative act. My paper ‘Hobbes and the Motivations of Social Contract Theory’ was published in this journal in 1994. In this contribution I explain the background that led me to write that paper at an early stage of my career, relating the explanation to my education as a student at UCL, and, briefly, at Harvard and contrasting the methodological approaches I experienced in the two departments. The Hobbes paper itself offers a type of ‘rational reconstruction’ of Hobbes, drawing on the logic of (...) different social contract arguments, and while there is much in the paper I still agree with, it assumes an approach to Philosophy that I would not adopt now. Der neue politische Realismus erkennt in John Rawls einen Erzfeind. In jüngeren Debatten scheint oft evident zu sein, dass gerade Eine Theorie der Gerechtigkeit exemplarisch für einen Moralismus sei, der die politische Wirklichkeit verzerre. Doch die Sache ist kompliziert. In diesem Aufsatz blicke ich zurück auf sein Frühwerk im Lichte dieser Kritik. Dabei geht es mir um vier Einwände: dass Rawls’ Idealtheorie kein Ratgeber für das politische Handeln und ideologisch verblendet sei; Macht und ihre Legitimierbarkeit nicht überzeugend konzipiere; die Bedeutung (...) politischer Konflikte und Uneinigkeit über den Inhalt der Gerechtigkeit unterschätze; und verkenne, dass eine wahrlich politische Theorie auf die Geschichte eingehen müsse. Wie stichhaltig sind diese Vorwürfe und was fördern sie zutage? Der Aufsatz zeigt, dass selbst Rawls’ erstes Hauptwerk nicht so einfach eines Moralismus überführt werden kann, wie es auf den ersten Blick den Anschein hat. Damit meine ich nicht, dass die Einwände allesamt keinen Biss hätten. Doch werden die Rechtfertigungslasten der Rawls’schen Gerechtigkeitstheorie nicht immer gebührend berücksichtigt; und manche Konterpunkte sind gerade bei wichtigen philosophischen Weggabelungen nicht ausreichend mit argumentativer Substanz untermauert. Wer einen Anti-Moralismus verficht, wofür es gute Gründe gibt, sollte weiterhin das konstruktive Gespräch auch mit dem frühen Rawls suchen und auf die internen Spannungen sowie realistischen Konzessionen seines Egalitarismus achten. Feminism, poststructuralism, postcolonialism, and Marxism, among other critical approaches, have undermined traditional notions of aesthetics in recent decades. But questions of aesthetic judgment and pleasure persist, and many critics now seek a "return to aesthetics" or a "return to beauty." Janet Wolff advances a "postcritical" aesthetics grounded in shared values that are negotiated in the context of community. She relates this approach to contemporary debates about a committed politics similarly founded on the abandonment of certainty. Neither universalist nor relativist, (...) the "aesthetics of uncertainty" provides a discourse on beauty that contemporary critics can engage with and offers a basis for judgment that is committed to assigning value to works of art. Wolff explores her position through a range of topics: the question of beauty in relation to feminist critique; the problematic status of twentieth-century English art, visual representations of the Holocaust, Jewish identity as portrayed by the artist R. B. Kitaj, refugee artists and modernism in 1940s Britain, and the nature and appeal of imagistic thinking in sociology. She addresses the desire for certainty and the timeliness of doubt and concludes with a meditation on the intersection of aesthetics and ethics, arguing that ethical issues are very much implicated in aesthetic discourse. Research on the history of ethics has ignored Alexander Gottlieb Baumgarten miserably. And that even though Kant based his lectures on moral philosophy on Baumgarten's text books over the course of decades. This article takes up the cudgels for this "in ethicis" most independent follower of Wolff. In addition to Baumgarten's epistemological elevation of perception, which is known to have resulted in the new foundation of aesthetics as an independent discipline, his reception of two lines of tradition was primarily (...) decisive for an original further development of Wolff's basic approach. First, Baumgarten gave his practical philosophy a strong legal flavor through orienting it toward the natural law theory of his Jena teacher Heinrich Köhler. This legal character can be seen mainly in the then resulting predominance of the concept of obligation. Second, Baumgarten secularized the heritage of pietism in Halle by emphasizing the need for lively perception in order to act morally. Both with his orientation toward an ethics of duty, as well as with his highlighting of motivation, he laid the foundation for Kant's seminal transformations in this field.Die ethikgeschichtliche Forschung hat Alexander Gottlieb Baumgarten bisher sträflich vernachlässigt, obgleich Kant über Jahrzehnte hinweg dessen Handbücher seiner Vorlesung über Moralphilosophie zugrundegelegt hat. Demgegenüber möchte der vorliegende Beitrag eine Lanze für den auch 'in ethicis' selbständigsten Wolffianer brechen. Neben der erkenntnistheoretischen Aufwertung der Sinnlichkeit, die sich bekanntlich in der Neubegründung der Ästhetik als einer eigenen Disziplin niederschlug, war vor allem die Rezeption zweier Traditionslinien für eine originelle Fortentwicklung des Wolffschen Grundansatzes maßgeblich: Zum einen verlieh Baumgarten seiner praktischen Philosophie durch die Orientierung am Naturrecht seines Jenenser Lehrers Heinrich Köhler ein stark juridisches Gepräge, wie dies vor allem an der nunmehrigen Vorherrschaft des Verbindlichkeitsbegriffs abzulesen ist. Zum anderen säkularisierte er das Erbe des Halleschen Pietismus, wenn er etwa die Notwendigkeit lebendiger Erkenntnis für das sittliche Handeln unterstrich. Sowohl mit der pflichtethischen Ausrichtung als auch mit der Akzentuierung des Motivationsproblems hat er Kants epochemachenden Umwälzungen auf diesem Gebiet entscheidend vorgearbeitet. (shrink)

Levinas' exploration of the ethical serves as point of entry and is shown to be seeking inter-cultural political relevance through engagement with the issues of postcoloniality and humanism. Yet, Levinas fails to realise the ethical implications of the inevitable instrumental mediation between ethical meaning and political practice. With recourse to Weber, Apel and Ricoeur, Ernst (...) The aim of the present paper is to analyse compactness properties of nonmonotonic inference operations within the framework of model theory. For this purpose the concepts of a deductive frame and its semantical counterpart, a semantical frame are introduced. Compactness properties play a fundamental in the study of non-monotonic inference, and in the paper several new versions of compactness are studied.

Depositors have perceived banks as acting unethically during the most recent recession. One area of consternation is the ambiguity of the legal obligations entailed by the deposit contract when it is backed with only fractional reserves. In this article, we apply an existing analysis of the legitimacy and ethicality of banking practices to a wider range of financial transactions, including insurance policies, securities lending, perpetual bonds, and callable loans. Securities lending in particular creates rights violations analogous to those in fractional-reserve (...) banking. Both callable loans and perpetual bonds have clear legal obligations which are not inherently problematic, though we herein clarify what these obligations are. Finally, we apply our ethical framework to demonstrate that insurance products are distinct from banking deposit contracts, and that perceived parallels between the two products underestimate these differences.
